This document (“Terms”) lays out the conditions of use and rules of operation of the clotho.ai website (“Website”) and the services provided through it (“Services”), in order to ensure their informed and proper use by you.
The Website is created and operated by Clotho AI (“we”, “us”, “our”), registered as a SASU in France (RCS Versailles, n°838 766 269), with registered office at 3, rue du Comte d’Orsay 78240 Chambourcy, France.
Please read these Terms in their entirety and ensure that you fully understand them prior to using the Services. The creation of your account constitutes full consent to these Terms.
We may update these Terms (or any part thereof) at our sole discretion and without prior notice. Your agreement with the updated Terms will be requested and will be necessary for you to continue using the Services. These Terms (or any part thereof) are applicable one month after their date of publication on the Website.
You may access and use our Services if and only if you meet all of the following conditions:
Our Services are intended to provide technological tools that can accelerate and increase the scientific rigour of forensic work. The core functionalities of our Services include:
You may only access and use our Services by connecting to the Website using a web browser. Most of the functionalities of our Services require the creation of an account; some of these functionalities are free, while others require the purchase of a licence or a subscription.
From your online account, you may consult the licences and subscriptions available to you, and you may register an institution with which you are affiliated provided that you are duly authorized to represent it and make payments on its behalf.
Access to certain features of the Services requires the purchase of a licence. Licences may be purchased on a standalone basis or as part of a subscription, which automatically renews your licence on a periodic basis. Applicable pricing and available plans are described on the Website. Payment is processed exclusively by our payment provider using the payment methods available at checkout. In the event of a failed or overdue payment, we will notify you and make reasonable attempts to collect the amount due. If payment cannot be collected within 7 days of the failed or overdue payment notification, we reserve the right to suspend or terminate your access to the relevant paid features.
We reserve the right to modify our pricing at any time. We will notify you of any price change at least 30 days before it takes effect. If you do not accept the new pricing, you may cancel your subscription before the change takes effect, in which case your access will continue until the end of your current billing period. Continued use of the Services after a price change takes effect constitutes acceptance of the new pricing.
Subscriptions and licences are non-refundable. If you cancel a subscription, you will retain access to the associated features of the Service until the end of your current billing period, after which your access will not be renewed. In the event of account termination, your access to the Services will end immediately with no refund.
In accordance with Article L221-28, 13° of the French Consumer Code, by confirming your purchase and consenting to the immediate provision of the Services, you expressly acknowledge that you waive your right of withdrawal (droit de rétractation) under Articles L221-18 et seq. of the French Consumer Code. This waiver is confirmed at the time of purchase.
We reserve the right to issue refunds at our sole discretion, including but not limited to cases of significant service outage or billing error.
Your account and account credentials (login and password) are for personal use only and should not be shared with anyone else. You are responsible for all use (including any unauthorized use) of your credentials, and for keeping them or any connected account used for login (such as Google account) safe. Notify us immediately if your credentials have been lost or compromised, or if you believe there has been unauthorized access to your account.
You are responsible for ensuring that all data that you input across the Services, including but not limited to your personal and professional information, your institution information, your forensic assessments, and your collected research data (such as text, images, 3D) are accurate; for keeping this data up-to-date; and for ensuring that you have the necessary rights, licences, or permissions to input this data on the Services.
If you or your institution conduct data collections through the Services, you are solely responsible for ensuring that all data is collected in a lawful and ethical manner, including obtaining the necessary approvals, consents, and authorizations required by applicable law, applicable ethics frameworks, and applicable codes of conduct. Institutions must additionally obtain Clotho AI’s approval prior to initiating any data collection, and must provide all information required to obtain informed consent from participants on the Website.
You are responsible for ensuring that the Services are appropriate for your use case. In the specific case of evidence assessment, this includes but is not limited to reviewing the guidelines provided, performing any validation necessary for your environment and use case, and ensuring that results are interpreted in accordance with those guidelines.
Please notify us immediately if you are aware of any data inaccuracies, data privacy or security vulnerability, or security breach within the Services.
Do not use any data accessible to you through the Services beyond the scope of the licence granted to you under these Terms. In particular, do not use any such data for investigative or law enforcement purposes.
